The U.S. General Services Administration (GSA) has implemented a nationwide Water Testing Modification Effort to help protect the health and safety of federal employees, visitors, and building occupants. As part of this initiative, GSA is issuing unilateral lease amendments (ULAs) to landlords of federally leased properties, requiring comprehensive drinking water testing within tenant spaces and common areas. This effort is designed to identify and address potential water quality concerns resulting from water stagnation, aging plumbing systems, and the possible presence of harmful contaminants, including Legionella bacteria.

Beginning in February 2024, landlords receiving a ULA are required to complete a one-time baseline water quality assessment and submit the results to GSA within 90 days. The testing program includes analysis for lead, copper, total coliform bacteria, and Legionella, all of which can present significant health risks if found at elevated levels. Compliance with these requirements is mandatory and must be performed according to GSA’s prescribed scope of work.

To assist property owners with compliance costs, GSA is providing reimbursement of up to $3,500 for baseline testing activities. However, landlords are responsible for retaining qualified environmental professionals to perform the testing and must take immediate corrective action if results indicate exceedances of applicable drinking water standards. Failure to complete testing within the required timeframe could result in compliance issues, additional scrutiny, or delays in lease administration.
